Agreement of Release and Waiver of Liability

 

1. I recognize that engaging in wellness practices may at times be strenuous and require physical exertion and movement that may involve a risk of physical injury, as well as could be emotionally engaging.

2. I understand that I am responsible for judging my own physical, mental, and emotional capabilities and limitations and that it is my responsibility to determine that there is no medical reason to prevent my practice and participation in different wellness modalities.

3. I agree to take full responsibility for not exceeding my physical and emotional capabilities and limitations during my practice and participation. 

4. I agree to take full responsibility for any injury I may suffer during my practice and participation. I agree that it is my responsibility to notify the practitioners of any physical injury or other condition affecting my ability to practice and participate in wellness modalities and that I will inform the practitioner immediately if any injury does occur during class or program.

5. I hereby waive and release any claim that I may have at any time for injury of any kind against Three Trees Enterprises, Three Trees Wellness, and all of its related business entities, practitioners, teachers, coaches, contractors, employees, or any person or entity involved therewith, including but not limited to its principals, instructors, employees, agents, and representatives.

6. I have carefully read the above release and waiver of liability and fully understand its contents and I voluntarily agree to the terms and conditions stated above by signing below.

7. By booking, you are agreeing to this waiver and you are electronically signing this waiver.

 

Class Cancelllations and Booking Ettiquete

1. You will be fully charged for a class that you sign-up for and do not attend or the class will be removed from your package. Students with unlimited packages will be charged the single drop-in rate for no-showing to a class under these terms.

2. Workshop and event cancellations must be made 48 hours prior to the start of the reserved workshop or event. If you do not attend or cancel within 48 hours of start time, you will be fully charged for the workshop and will not be able to use the credit for a future workshop.

3. Workshops, events and trainings are non-refundable. Credits will not be provided for enrollments canceled by student less than 5 days before the event.

4. Please cancel if you are unable to attend a class or workshop to make your space available to others who can attend.

5. Payment must be made upon booking. No students will be permitted to sign-up for a class, workshop, or event as unpaid unless it is a free or donation based class. Unpaid classes or membership payments will be back-charged and a $10 fee will be charged.

 

GIFT CARDS

1. Gift cards can be redeemed for classes, workshops, programs, account credit, and/or retail purchases.

2. Gift cards can be purchased and sent electronically through our online store.

3. Gift cards are nonrefundable and not redeemable for cash.

 

TERMS & CONDITIONS

1. All purchases of services (classes, workshops, events) are non-refundable.

2. Purchases of products are only refundable in new and unused condition up to 15 days after purchase.

3. All participants must have a unique online account associated with a unique email address. Friends and family members may not share the same email address.

4. Payment must be made upon booking. No students will be permitted to sign-up for a class, workshop, or event unpaid unless it is a free or donation-based class. Unpaid classes or membership payments will be back-charged.

5. Three Trees Enterprises and its affiliates are not responsible for the safekeeping of your personal belongings.

6. You agree that you have been examined by a qualified medical practitioner within the past six months and have been found by such practitioner to be in good physical health and physically able to perform all wellness classes. It is the responsibility of the student and participants to notify teachers or practitioners of any previous injury, illness, or conditions that may impact their practice. Classes at Three Trees Enterprises and its affiliates may be physically strenuous and you voluntarily participate in them with full knowledge that there is the risk of personal injury, property loss, or death.

7. You will follow all instructions given to you by Three Trees Enterprises and its affiliates teachers and you acknowledge that any failure to do so will be at your own risk and may cause injury.

8. In attending classes and programs at Three Trees Enterprises and its affiliates, you agree that neither you, your heirs, assigns, or legal representatives will sue or make any other claims of any kind whatsoever against Three Trees Enterprises and its affiliates or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

9. Three Trees Enterprises and its affiliates reserve the right to refuse entry or service.

10. Prices may increase from time to time to reflect increases in cost and benefits.

11. Terms, Conditions, and Fees are subject to change without prior notification.

12. By booking into a class or offering you automatically agree to the above terms & conditions.

13. All purchases of services (classes, workshops, events) are non-refundable.

14. Purchases of products are only refundable in new and unused condition up to 10 days after purchase.

15. Credits may be given for special events or workshops if registration is canceled within 5 business days of the date of the event or workshop, only if noted within the refund details on the specific event or workshop listing.

Google: If you provided us with your first name, last name, e-mail address, and phone number by filling out the contact us form on our website, your information is collected and stored on Three Trees Enterprises and its affiliates’ Google Drive on Google. Review Google’s Privacy Policy on their site.

2. Your information can only be accessed by Alicia Lerrigo or administrative staff as necessary for doing business.

3. Your Information can be accessed by Alicia Lerrigo and the staff of Three Trees Enterprises in the normal course of doing business.

4. If you would like any of your information deleted, please email Alicia@threetrees.io

5. You may be asked to store your credit card information. This will be completely voluntary and used to easily sell you services from Three Trees Enterprises and its affiliates.

6. If you subscribe for a monthly auto-renew you will be asked to give consent to store your credit card information for future billing. Should you ever cancel your auto-renew, you can email Alicia@threetrees.io to delete your stored information.

7. All such information is strictly protected and used only for delivering the content and products the user has signed up for or purchased. This information is never used for other purposes and is never shared with 3rd parties. This data can be deleted at the request of the consumer as long as it complies with the signed contract.

2. MindBodyOnline creates accounts, schedule classes, make purchases, and collect automatic payments.

3. Facebook for promotions.

4. Wix to host our website and send emails and promotions.

5. Google Drive to store data lists.

6. www.threetrees.io does not share your information with these processors/vendors. Information will only be provided to these processors by YOU when you sign-up at these sites. The information collected by these processors is stored by them. You may review the privacy policies of the associated processors at any time.
